Terms of Service

1. Acceptance of Terms

BuyerWise is a software product operated by Belanger Home Inspection LLC, doing business as “BuyerWise.” These Terms of Service (“Terms”) are a legal agreement between you (“you” or “your”) and Belanger Home Inspection LLC d/b/a BuyerWise (“BuyerWise,” “we,” “us,” or “our”) governing your access to and use of the BuyerWise website and service (collectively, the “Service”). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

The Service is a software tool that uses artificial intelligence to summarize home inspection reports. It is not itself a home inspection, nor is it the provision of home inspection services, and using the Service does not create an inspector-client relationship with Belanger Home Inspection LLC or any of its inspectors.

2. Eligibility

You must be at least 18 years of age and able to form a legally binding contract to use the Service. By using the Service, you represent that you meet these requirements. The Service is intended for use by prospective home buyers and homeowners for personal, informational purposes.

3. Description of Service and AI Disclaimer

The Service provides automated, AI-generated summaries and analyses of home inspection reports you provide. You explicitly acknowledge and agree that:

  • The Service is powered by artificial intelligence and natural language processing.
  • The AI may make errors, omit critical information, fabricate facts (“hallucinate”), misinterpret the severity of issues, miscategorize findings, or produce inaccurate cost or time estimates.
  • The Service does not constitute professional engineering, architectural, legal, financial, real estate, or home inspection advice.
  • Cost estimates provided by the Service are AI-generated approximations and are not quotes, guarantees, or accurate reflections of local contractor pricing.
  • You must independently verify all findings, estimates, and recommendations with a licensed professional (e.g., a certified home inspector, licensed contractor, or real estate attorney) before making any real estate transaction, negotiation, or purchase decision.
  • The quality and usefulness of the output depend directly on the quality and completeness of the inspection report you provide.

4. User Responsibilities and Uploaded Content

You are solely responsible for the documents you upload (“User Content”). By uploading a report, you represent and warrant that you have the legal right and authority to upload and process the document, including any permission required from parties named in the report (such as inspectors, agents, or sellers) under applicable law. You agree not to upload documents containing highly sensitive personal information (such as Social Security numbers or financial account details) that are not typically found in a standard home inspection report.

You retain ownership of your User Content. You grant BuyerWise a limited, worldwide, royalty-free license to host, reproduce, transmit, and process your User Content solely to operate and deliver the Service to you (including sending report text to our third-party AI provider for analysis and storing the resulting output). We do not fine-tune any AI model on your User Content. See our Privacy Policy for how we handle your content.

5. Acceptable Use

You agree not to:

  • Use the Service in violation of any law, regulation, or third-party right.
  • Upload content that is unlawful, infringing, defamatory, or contains malware, viruses, or any other harmful code.
  • Upload documents you do not have the right to upload, or documents that are not home inspection reports for the purpose of circumventing or abusing the Service.
  • Attempt to reverse engineer, decompile, disassemble, scrape, or otherwise derive the source code, prompts, models, or underlying algorithms of the Service.
  • Interfere with or disrupt the Service, its servers, or networks, or attempt to gain unauthorized access to any part of the Service or to other users’ data.
  • Use automated systems (bots, scripts, scrapers) to access the Service in a manner that exceeds what a human user could reasonably do through a standard browser.
  • Resell, sublicense, or otherwise commercially redistribute the Service or its output without our prior written consent.
  • Remove, obscure, or alter any copyright, trademark, or other proprietary notices from the Service.

We may suspend or terminate your access and refuse service at our discretion for any violation of these Terms.

6. Intellectual Property

The Service, including its software, AI prompts and workflows, user interface, design, text, graphics, logos, and branding (“BuyerWise IP”), is and remains the exclusive property of BuyerWise and its licensors, protected by copyright, trademark, and other intellectual property laws. Except for the limited right to use the Service in accordance with these Terms, you receive no right, title, or interest in the BuyerWise IP.

If you send us suggestions, comments, ideas, or feedback about the Service (“Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that Feedback into the Service without any obligation or compensation to you.

7. Disclaimer of Warranties

THE SERVICE AND ALL OUTPUT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AND SECURITY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE AI WILL IDENTIFY ALL ISSUES IN A REPORT OR PRODUCE ACCURATE OR COMPLETE OUTPUT. YOUR USE OF AND RELIANCE ON THE SERVICE IS SOLELY AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BELANGER HOME INSPECTION LLC (D/B/A BUYERWISE), ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, REVENUE, PROFITS, GOODWILL, OR PROPERTY VALUE) ARISING OUT OF OR CONNECTED WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE, OR FOR ANY DECISIONS MADE BASED ON THE AI-GENERATED OUTPUT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Your sole and exclusive remedy for dissatisfaction with the Service is to stop using the Service. In no event shall our total aggregate liability to you exceed US $10.00.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless Belanger Home Inspection LLC (d/b/a BuyerWise) and its members, officers, employees, agents, affiliates, and partners from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service or any output you relied on; (b) your violation of these Terms; (c) your violation of any law or any right of a third party, including intellectual property or privacy rights; or (d) any content you upload to the Service. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

10. Third-Party Services

The Service relies on third-party APIs and infrastructure, including AI processing, cloud hosting and database, transactional email, and analytics providers. We are not responsible for the uptime, accuracy, security, or data practices of these third-party services beyond what is outlined in our Privacy Policy. Your use of those third-party services may be subject to their own terms.

11. Service Issues

The Service is currently provided free of charge. If the Service fails to deliver a usable analysis, email support@buyerwise.app with your report ID and we will re-run the analysis at no cost.

12. Termination

We may suspend or terminate your access to the Service at any time, without notice and without liability, if we believe you have violated these Terms, misused the Service, or exposed us or other users to legal, security, or operational risk. Upon termination, your right to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination will survive, including the disclaimers, limitation of liability, indemnification, intellectual property, and dispute resolution provisions.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in the State of Michigan, and you consent to the personal jurisdiction and venue of those courts.

Jury Trial Waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND BELANGER HOME INSPECTION LLC (D/B/A BUYERWISE) EACH WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.

Class Action Waiver. ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. If a change is material, we will provide reasonable notice by updating the “Last Updated” date above, posting the revised Terms on this page, and/or notifying you through the Service or by email. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.

15. General Provisions

  • Entire Agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and BuyerWise regarding the Service and supersede any prior agreements or understandings.
  • Severability. If any provision of these Terms is held unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full effect.
  • Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
  • Notices. We may provide notices to you via email to the address you provided when submitting your report, or by posting on the Service.
  • Force Majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, pandemics, power or network failures, or failures of third-party service providers.
  • No Third-Party Beneficiaries. These Terms do not create any rights in favor of any third party.
  • Relationship. No agency, partnership, joint venture, or employment relationship is created by these Terms.
